This settlement is related to a consumer class action lawsuit in California federal court, titled In re: Kia Hyundai Vehicle Theft Marketing, Sales Practices, and Products Liability Litigation, No. 8:22-ML-3052 JVS(KESx) (C.D. Cal.). The lawsuit claims certain Hyundai vehicles from 2011-2022 lack an engine immobilizer, making them prone to theft and damage.
Settlement Benefits
Under the proposed settlement, Hyundai will offer various forms of compensation:
Free Software Upgrade: For eligible Class Vehicles, this upgrade prevents the car from being started without a key, countering a theft method popularized on social media. Additionally, up to $50 reimbursement for steering wheel locks purchased before the Software Upgrade's availability is offered.
Reimbursement for Anti-Theft Devices: If your vehicle is ineligible for the Software Upgrade, you can receive up to $300 for anti-theft devices like steering wheel locks or glass breakage alarms.
Common Fund Compensation: An $80 million to $145 million fund will cover approved claims for:
- Up to 60% of the vehicle's Black Book Value for total loss due to theft.
- Up to $3,375 or 33% of the vehicle's Black Book Value for theft damage.
- Up to $375 for insurance deductibles and premium increases.
- Up to $250 for other expenses, including transportation and towing.
- Reimbursement for key fobs needed for the Software Upgrade.
Legal Rights and Options
